Lula’s defense calls for suspension of Lava Jato prosecutors
Aug 14 (Prensa Latina) Luiz Inácio Lula da Silva’s defense filed a habeas corpus to request the suspension of prosecutors of the Lava Jato operation who acted in legal proceedings against the former president in Curitiba, judicial sources confirmed today.
Also in the appeal, lawyers Cristiano and Valeska Zanin included a request for a court order to restore the freedom of the former worker leader, who since April 7, 2018 has been serving a prison sentence for alleged acts of corruption.
The habeas corpus argumentation shows that Lula’s rights to impartiality and the presumption of innocence, guaranteed by the Constitution, were not respected in the process.
The most important news of this claim is the inclusion of the messages published in reports of The Intercept site, in collaboration with the newspaper Folha de Sao Paulo, the magazine Veja, the portal UOL, among other news media. According to the defense, the conversations prove that the investigations against Lula come from a command issued by the former judge and Minister of Justice, Sérgio Moro, to prosecutor Deltan Dallagnol, coordinator of Lava Jato.
The filtrations also revealed that the prosecutors knew that there was no evidence against the founder of the Workers Party in the case of the triplex apartment in Sao Paulo, nor any link with the state-owned company Petrobras.
In spite of this, they filed a complaint and asked for the conviction of the former president. During the process, they acted with clear personal and political motivation, and they were under former Judge Sérgio Moro’s coordination and guidance,” denounced the ex-unionist’s lawyers.
They demanded that the complete messages exchanged between the prosecutors and Moro, which are related to Lula, be shared in the habeas corpus.
After two months of repeated questions about Dallagnol’s conduct behind the scenes of the Lava Jato, the National Council of the Public Prosecution Service will finally begin an investigation into it.
